Dane Muller Coaching

Dane Muller trading as The Muller Family Trust (ABN 28441328148) (hereafter “Dane Muller”)

 

Customer means the party identified in the Schedule engaging the services of Dane Muller programs, services, courses and similar synonyms are used interchangeably. 

 

Services means the services referred to in the “Our Services” section, and as may be further identified or particularised in the Schedule. 

 

Our Prices and Fees 

1. All prices quoted are in Australian Dollars. 

2. All prices quoted, are for the listed and mentioned services only and are subject to change in line with third party providers, the Australian dollar and other unforeseen circumstances. 

3. Customers may be required to enter into arrangement with third parties in order to allow for the services of Dane Muller to be provided. Any such agreements are between the Customer and the respective third parties. Dane Muller encourages Customers to review any terms and conditions prior to acceptance. 

 

Payment of our Invoices 

4. To secure placement in a program, Dane Muller requires payment in full, upfront. 

5. If the Customer does not wish to pay in full, upfront, then at the sole discretion of Dane Muller the Customer must enter into a direct debit agreement with a third-party provider, which is to be introduced by Dane Muller. 

6. In the event that direct debit agreement is entered into, a non-refundable deposit to be paid by the Customer to Dane Muller is required. 

7. Throughout any program, Dane Muller requires payment for the services to be provided prior to the Customer engaging in the next stage of the program. 

8. Failure to make the requisite payment will result in services being placed on hold and the Customer’s place in any program cancelled. 

Refund Policy and Cancelation Policy 

9. Upon commencement of the services, which occurs upon the commencement of the provision of the services, Dane Muller has a ‘no refund’ policy due to the individualised content of each program developed for Customers. This is subject to Australian Consumer Law. If there are any issues with the packages or service you have been provided, please contact Dane Muller’s administrative team via email at: [email protected] We would like the opportunity to work with you in relation to your issues, whatever they may be. 

10. With the exceptions provided by Australian Consumer Law, a Customer may not cancel a program that they have purchased. Dane Muller has a finite capacity in relation to the services that it can provide and requires payment in order to cover the opportunity cost associated with the cancellation. 

11. In the event of illness certified by a medical professional, or other justifiable reason for withdrawal from a program, services may be suspended by the Customer upon request, in writing to 

[email protected]. Such withdrawal is at the discretion of Dane Muller. Should withdrawal be agreed, credit will be provided towards another program.

 

Our Services 

12. Dane Muller provides transformational mentoring, education and coaching in Neurolinguistics programming, Emotional Change Technique®️, Hypnosis and Life and Business Mentoring to Customers.

13. Dane Muller does not offer its products or services to people under the age of 18 years. The relevant time for determining a potential Customer’s age is at the time of paying the upfront fees required by these terms and conditions. 

14. The services provided by Dane Muller are merely indicative and general in nature, the advice is not directive, nor does it amount to counselling, financial, nor legal advice. Any such advice should be sought

from a qualified expert. 

15. The Customer agrees that Dane Muller may, in the provision of the services, ask personal questions and make requests for the specific purpose of reminding the Customer of their own, previously provided, intentions. If discussing personal issues may result in a risk to the Customer, then the Customer must disclose this prior to engaging the services of Dane Muller. 

16. The Customer warrants they are medically fit to undertake the personal development program offered by Dane Muller. 

17. Dane Muller acknowledges that any personal information discussed during the provision of the services shall be kept in confidence and shall not be disclosed unless compelled at law. 

18. Dane Muller will take all reasonable steps to ensure that its employees and agents, and any subcontractors engaged for the purposes of this agreement, do not make public or disclose the Customer information and data which would reasonably be expected to be kept in confidence, unless legally compelled to do so. 

19. The Customer requests the services at his or her own risk. Dane Muller will not be held liable for any losses or damages caused as a result of services purchased from Dane Muller. 

20. The Customer agrees that any strategies implemented by Dane Muller remain the intellectual property of Dane Muller and may not be used outside the terms of this engagement, save for where expressly provided for. 

21. It is the responsibility of the Customer that all materials (including, but not limited to images, diagrams, data, as well as intellectual property in other media) supplied to Dane Muller by the Customer will have the relevant copyrights, licences and permissions for use in the services of the Company. 

22. The Customer is also responsible for the accuracy of their instructions and directions to Dane Muller. Dane Muller will not accept responsibility/liability for infringements or inaccuracies caused by any wrongly supplied instructions or materials. 

23. Dane Muller reserves the right to commission freelance support or outsource any task if it is felt it is in the best interests of the Customer, or having regard to the operational requirements of Dane Muller. Any outsourced job remains the property/responsibility of Dane Muller and such services are deemed to be carried out ‘indirectly’ by Dane Muller. 

24. Dane Muller makes no guarantee or warranties, either express or implied, outside of that required by Australian Consumer Law. 

 

Customer Code of Conduct 

25. The Customer agrees to be bound by the Code of Conduct expressed in clause 26, failing compliance with, Dane Muller may immediately terminate the agreement and cease to provide services without notice. 

26. The Customer must: 

(a) Provide full Disclosure of all facts, matters and things relevant to this agreement;

(b) Be Patient; 

(c) Communicate fully and respond to reasonable requests for information or directions from Dane Muller; and 

(d) Comply with all laws. 

27. In the event that Dane Muller terminates the agreement with the Customer pursuant to this clause, no refund is to be provided. 

Privacy 

28. Dane Muller takes your privacy seriously. Dane Muller will protect your personal information regarding the use of personal information as required by Australian Privacy Laws Privacy Laws as well as European requirements for Customer’s based in that location. Dane Muller will not use your personal information except for the purpose of engaging in and entering into and completing a transaction necessary to the provision of the services, and/or to comply with any reporting requirements (such as taxation returns or Government Directives). The Customer must ensure that before disclosing any personal information to Dane Muller that the Customer is entitled to disclose that information as required by the Australian Privacy Laws . If the Customer becomes aware of any breach or alleged breach of the Privacy Laws concerning information disclosed by Dane Muller to the Customer or any other party, or by the Customer to Dane Muller, then the Customer must notify Dane Muller immediately via the email to [email protected]. Likewise, Dane Muller will notify the Customer, and if necessary, the Office of the Australian Information Commissioner if Dane Muller becomes aware of any breach or any alleged breach of the Privacy Laws concerning information disclosed. 

 

Security 

29. Any transactions completed online with Dane Muller are completed using SSL technology, which provides the high-level encryption for online transactions.

30. In the event the Customer’s credit card information is taken by Dane Muller for the purposes of making a credit card transaction to purchase a package the credit information is destroyed after the transaction is successfully made. This is an essential element of Dane Muller’s engagement. 

31. Any online payment that is transacted via third party providers is subject to the terms and conditions imposed by those providers. 

General 

32. Dane Muller reserves all rights in relation to intellectual property created and used by it on its website, social media platforms and in any documentation. Dane Muller has taken every measure to ensure that it has permission to use the intellectual property of others. Any misuse of copyrighted material by Customers or users of any website, social media platform or publication operated by Dane Muller is strictly prohibited. 

33. Customers agree that Dane Muller may photograph or otherwise record the delivery of the services connected to the program, including photographing or recording the Customer, which may identify the Customer. The Customer agrees that this material may be used in marketing material by Dane Muller this also includes any testimonials provided by Customers. 

34. Terms and Conditions may be changed at any time without prior notice to its Customers. Notification will be sent to all Customers at the time of the Terms and Conditions alterations. 

35. Dane Muller shall be under no liability if it should be unable to carry out any provision of this agreement for any reason beyond its control. 

36. The Customer is agreeing fully to Dane Muller’s Terms and Conditions of Trade by electing to engage the services of Dane Muller. 

37. Participating in recorded sessions as part of a program or group container is deemed to be providing consent to use pictures, video or audio recordings for future evergreen production of the course or program. The customer acknowledges that any reproduction thereof shall remain the property of Dane Muller Coaching. 

38. When you purchase any product or service, enter into any of our free and paid memberships, book a discovery call or request access to a free product, you are giving permission to opt-into marketing communications with us. 

39. We may, from time to time, send you newsletters, invitations and updates about our services to which you can opt-out of at any time. 

 

I acknowledge and consent that images may appear publicly as part of Dane Muller Coaching’s website and/or other marketing materials. 

 

 

MULLER COACHING & MENTORING  

RETREATS PARTICIPATION FORM

 

 

Please carefully read the below terms and fill out the information requested.

 

All rights referred to as Muller Coaching & Mentoring (Incorporating Nadine Muller Coaching & Mentoring (NMCM) and Dane Muller Coaching & Mentoring (DMCM) to be hereinafter shown as MCM.

 

Our responsibility to you

As the retreat operator, we make arrangements with other parties to provide you with some of the services on your retreat. These parties are independent suppliers over whom we have no direct control. MCM is not responsible for any claims, losses, damages, costs or expenses arising out of injury, accident or death, damage, loss or delay of baggage or other property; or delay, inconvenience, loss of enjoyment, or frustration, whether physical or mental resulting from:

• the act or omission of any party including MCM or its employees;
• mechanical breakdown, government actions, weather or other factors beyond our control; 
• your failure to read information provided and follow instructions including, but not limited to, obtaining sufficient travel protection & health insurance and providing correct & complete personal, health and travel information;
• your cancellation or change for any reason in travel services offered; and
• your medical or health problems or physical disabilities.
• We maintain a standard of never cancelling a retreat which has guests booked on it, but in the event of a cancellation made by us, MCM’S liability will be to allow a transfer of funds to further retreats and/or experiences. MCM is not responsible for any fees caused by such cancellation paid to airlines and any other agreements made by guests with outside operators.

 

Cancellations from Guests

Due to our commitment to accommodation providers, instructors, tour operators etc, we cannot make any exceptions to the below-mentioned cancellation fees. We do not offer any credit for arriving late or departing early, missing activities or not using any part of the scheduled program.

Dietary Restrictions, Medical History and (skin) Allergies

Participants must notify MCM of any dietary restrictions, medical history that requires medication or health support, and allergies through our form. Please list food and skin allergies or any other allergies or medication or health history that are important for us to know.

 

Contraindications of breathwork

Breathwork is a powerful healing modality and although usually a deeply relaxing and enjoyable process, it can result in certain specific physiological changes in the body and also sometimes intense physical and emotional release. Please be aware that sessions can cause and are not limited to:

• Tingling
• Dizziness
• Trembling, shaking or other physical sensations
• Emotional experiences
• Experience of energy moving through your body

As a precaution, the following conditions are contraindicated for anyone thinking of practising the Conscious Connected Breath and it is crucial that you inform our MCM breathwork practitioners before the session if any of the following conditions are relevant to you.

You can still join and we will guide you accordingly:

 

• Pregnancy first trimester
• Detached Retina or Glaucoma
• High Blood Pressure (not controlled with medication)
• Cardiovascular disease including angina, previous heart attack or stroke.
• Diagnosis of aneurysm in the brain or abdomen
• Uncontrolled thyroid conditions and diabetes
• Asthma – if you are asthmatic, you are welcome to attend providing you bring your inhaler to the session.
• Epilepsy
• Prior diagnosis of bipolar disorder, schizophrenia or previous psychiatric condition.
• Hospitalisation for any psychiatric condition or emotional crisis within the last 10 years.

Any other medical, psychiatric or physical conditions which would impair or affect ability to engage in any activities that involve intense physical and/or emotional release.

Liability waiver and Assumption of Risk 

In consideration of the services of MCM, their managers, owners, officers, volunteers, participants, employees, service suppliers and all other persons or entities acting in any capacity on their behalf, I hereby agree to release, indemnify, and discharge MCM, on behalf of myself, my children, my parents, my heirs, executors, administrators, assignees, personal representatives and estate as follows:

Accordingly, I agree that I am voluntarily participating in any and all activities, risks, and use of the accommodations, and hereby assumes all risk of injury, illness, damage or loss to person and property that might result, including, without limitation, any loss of personal property. I expressly agree and promise to accept and assume all of the risks existing in the practice of yoga, breathwork and physical activities with knowledge that the risks of participating in this activity include, but are not limited to, sprains, strains, broken bones, paralysis, even death; exhaustion.

I certify that I have adequate travel protection insurance should I need to cancel or change my travel plans & health insurance to cover any injury or damage I may cause or suffer while participating on any of the retreat activities, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.

I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless MCM, its officers, employees and suppliers against all claims of losses, causes of action, damages or expenses of claim and against any costs including legal fees that may be incurred. As a result of any such claims losses, damages or expenses whether valid or not, including any such claims which alleged negligent acts or omissions of MCM.

Should MCM or anyone acting on their behalf, be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs, and I declare to not take any legal action in any country.

Guests are responsible for any damage that may occur at the retreat venue during their stay and may be invoiced by the venue accordingly.

By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation on a retreat, I may be found by a court of law to have waived my right to maintain a lawsuit against MCM on the basis of any claim from which I have released them herein. This is to certify that MCM, its employees & suppliers are released from any responsibility for any loss, mishap, accident, injury or death that may occur during my participation at an MCM event or retreat.

 

Guests are responsible to settle any incidentals (drinks, mini-bar or anything consumed at the venue that is not part of the retreat inclusions) prior to checking out of the venue.

 

By signing this waiver I acknowledge that retreat photographs and images which include me can be published by MCM for the company’s marketing purposes only.

 

I have had sufficient opportunity to read the ‘terms & conditions’, and ‘liability waiver and assumption of risk’ proposed by MCM. I have read and understood all pages, and I agree to be bound by the terms.

ACKNOWLEDGEMENT & WAIVER

TO: The Muller Family Trust ABN 28 441 328 148, trading as Nadine Muller Coaching and Mentoring / Dane Muller Coaching and Mentoring & Heartled Warriors (hereafter the "Business")

 

I, the Customer noted at the foot of this document, provide this acknowledgment and waiver, voluntarily and with the opportunity to have taken advice as to the same.

 

As part of the services provided by the Business, I acknowledge that I may be invited to participate in activities that carry some inherent risks of injury, loss, or damage (including economic loss), and that those services include, but are not limited to:

• Retreats; and/or
• Workshops; and/or
• Day events; and/or
• Courses,(the "Services").

I acknowledge and agree that I am undertaking the activities connected to the Services offered by the Business freely, voluntarily, and at my own risk, and with a full appreciation of the nature and extent of all or any risks involved with these activities.

 

To the full extent permitted by law, I waive any legal rights of action against, and fully release, the Business, its officers, and duly authorized agents, for any loss, damage, injury, or death, howsoever arising out of or in relation to my participation in the Services offered by the Business, or by my participation in any of the activities associated with the Services offered by the Business.

 

This waiver shall be without limitation, for liability for any negligent or tortious act or omission, breach of duty, breach of contract, or breach of statutory duty on the part of the Business, its officers, or duly authorized agents.

 

This waiver must bind myself and/or my heirs, successors, executors, and/or administrators.
